Simple Divorce — Sole Application

A simple divorce (sole application) is the most straightforward path to a legal divorce in Canada. It is available when both spouses agree the marriage has broken down, there are no unresolved issues about property division or spousal support, and child support and parenting arrangements are either not applicable or already settled. The applicant applies alone under the Divorce Act — the other spouse does not need to co-apply, though they must be properly served.

This flat-fee package covers every step of the legal process: preparing your divorce application and all required court forms, commissioning your sworn documents, serving the application on the other party, and filing with the Ontario Superior Court of Justice. Once the 31-day appeal period passes after the divorce order is granted, you will receive a Certificate of Divorce.

**Disbursements are not included in the flat fee.** The government and third-party costs — court filing fees and process server fees — can total up to approximately $900 CAD and are charged at cost.
