Marriage Contract / Cohabitation Agreement — Drafting

A marriage contract or cohabitation agreement (commonly called a prenuptial agreement) allows spouses or partners to define how property, debts, and support will be handled during the relationship and in the event of separation. In Ontario, these agreements are governed by Part IV of the Family Law Act and must meet strict requirements to be enforceable. This package covers the full drafting of the agreement according to your instructions, a thorough review with you before execution, an ILA Certificate, execution of the agreement, and basic financial disclosure — all within an 8-hour engagement.

Frequently Asked Questions

Important Limitations

  • This package provides drafting and ILA for one party only. The other party must retain their own independent lawyer before the agreement can be executed.
  • The 8-hour included time covers most straightforward drafting engagements. If the matter requires additional time (e.g., complex asset structures), you will be advised and quoted before proceeding.
  • For an agreement to be enforceable in Ontario, both parties must have independent legal advice. We can refer the other party to counsel if needed.
  • This service is provided by a referral partner — a licensed Ontario family law firm.
