Joint Divorce

A joint divorce is available when both spouses agree to apply for divorce together and have resolved all issues arising from the marriage — property division, spousal support, and any parenting or child support arrangements. Because both spouses are co-applicants, no service of process is required, which simplifies the process and eliminates the need for a process server.

This flat-fee package covers preparing the joint divorce application and all required court forms, commissioning (swearing) the documents with both parties, and filing the application with the Ontario Superior Court of Justice. Once the 31-day appeal period passes after the divorce order is granted, you can obtain a Certificate of Divorce from the court.

**Disbursements are not included in the flat fee.** Court filing fees are charged at cost and may total up to approximately $700 CAD.

If you still need to resolve property, support, or parenting issues before proceeding, see our Separation Agreement — Drafting service.
